Child safety laws:


1.
Children under 16 years old must be secured in a child restraint system or safety belt.
2. Children younger than age 8 and who weigh less than 80 pounds must be properly secured in a child restraint. When a child reaches age 8 (regardless of weight) or 80 pounds (regardless of age), a properly fitted safety belt may be used.

3. If there is no lap and shoulder belt equipped seating position, a child less than 8 years of age and between 40 and 80 pounds may be restrained by a properly fitted lap belt only.
4. Penalties are not to exceed a $25 fine, even when more than one child is improperly restrained. No person charged under this provision may be charged for failure to have a child under five properly secured if he produces at the time of his trial proof that he has subsequently acquired an approved child passenger restraint system. Court fees will be applied to this provision. North Carolina has a statewide court fee of $86 for this type of charge. A violation of this provision may not appear on a driver's license, may not be reported to an insurance company and no points may be assigned to a driver's license.


Seatbelt laws:

1. Primary Enforcement
2. Each front seat passenger who is 16 years or older and every driver of a passenger motor vehicle shall have a safety belt on while the vehicle is in forward motion. For passengers under 16, the Child Passenger Safety Law applies.
3. This provision does not apply to:
I. A driver or occupant whose physical or medical condition prevents using a safety belt;
II. Rural letter carriers while delivering mail;
III. Newspaper delivery persons;
4. A driver or passenger who fails to wear a safety belt shall pay a $25 fine. Court fees may not be applied to this provision. A violation of this provision may not appear on a driver's license, may not be reported to an insurance company, and no points may be assigned to a driver's license. A conviction under this provision could result in a revocation of a person's license if the person is operating under a graduated license and is convicted under this provision.
