Disqualifications for driving:

You can be disqualified and lose your Commercial Driver's License for certain convictions. If convicted of two serious traffic violations in a commercial vehicle within three years, you may lose your license for 60 days. A third conviction within three years results in 120 days disqualification. Serious traffic violations include: 
Nebraska traffic school
  • Speeding 15 miles per hour or over the legally posted speed limit Willful reckless driving Improper lane change
  • Following the vehicle ahead too closely
  • A violation of any law or ordinance related to motor vehicle traffic control, other than parking violations or overweight or vehicle defect violations, arising in connection with an accident or collision resulting in the death to any person.

A driver is disqualified for one year for a first-time conviction of the following offenses while operating a commercial vehicle:

  • Driving under the influence of alcohol or any drugs;
  • Driving with an alcohol concentration of .04 or more;
  • Leaving the scene of an accident;
  • Using a commercial vehicle in the commission of a felony; or
  • Refusing to take a blood alcohol test.

If convicted of any of the above while transporting hazardous materials, the disqualification is increased to three years. A second conviction of any of the above may result in disqualification for life. The second conviction may be for the same or a different offense. Using a commercial vehicle in the making, selling, or distribution of drugs results in a life disqualification. Professional drivers do not drive commercial vehicles after drinking alcohol. If any level of alcohol is detected, law enforcement can place a commercial driver out-of-service for 24 hours. It is illegal. to operate a commercial vehicle with any alcohol in your system.


Out of Service Disqualification


If the driver is convicted of violating an out of service order the following disqualifications will be applied:


1st conviction = 90 day disqualification
2nd conviction (within 10 year period) = 1 year disqualification
3rd conviction (within 10 year period) = 3 year disqualification


If driver is convicted of violating an out of service order while operating a CMV and transporting hazardous materials or in vehicles designed to transport 16 persons including the driver = 180 day disqualification.
2nd or subsequent conviction while transporting hazardous materials or 16 or more passenger vehicle = 3 year disqualification.
