Driving Under the Influence of Alcohol or Drugs (DUI) Penalties

1st Offense

  • 6 months - 1 year driving privilege suspension
    $250-$400 fine
  • 12-48 hours at Intoxicated Driver Resource Center at a charge of $75 a day
  • maximum 30 days imprisonment
  • an automobile surcharge of $1,000 a year for 3 years
  • $100 surcharge to be deposited in a drunk driving fund
  • $100 Alcohol Education and Rehabilitation Fund
  • $75 Safe Neighborhood Services Fund
  • $75 Violent Crimes Compensation Fund

Second Offense

  • 2 years driving privilege suspension
  • $500-$1000 fine
  • 30 days community service
  • 12-48 hours at Intoxicated Driver Resource Center
  • 48-90 days imprisonment
  • an automobile surcharge of $1,000 a year for 3 years
  • $100 surcharge to be deposited in a drunk driving fund
  • $100 Alcohol Education and Rehabilitation Fund
  • $75 Safe Neighborhood Services Fund
  • $75 Violent Crimes Compensation Fund

Third Offense
 

  • 10 years driving privilege suspension.
  • $1,000 fine.
  • 90 maximum community service .
  • 12-48 hours at the Intoxicated Driver Resource Center.
  • 180 days imprisonment
  • an automobile insurance surcharge of $1,500 a year for 3 years
  • $100 surcharge to be deposited in a drunk driving fund
  • $100 Alcohol Education and Rehabilitation Fund
  • $75 Safe Neighborhood Services Fund
  • $75 Violent Crimes Compensation Fund
     

DUI in school zone or school crossing

1st Offense

  • 12-24 month driving privilege suspension
  • $500-$800 fine
  • 12-48 hours at Intoxicated Driver Resource Center at a charge of $75 a day
  • 60 days imprisonment
  • an automobile surcharge of $1,000 a year for 3 years
  • $100 surcharge to be deposited in a drunk driving fund
  • $100 Alcohol Education and Rehabilitation Fund
  • $75 Safe Neighborhood Services Fund
  • $75 Violent Crimes Compensation Fund


Second Offense

  • minimum 4 years driving privilege suspension
  • $1000-$2000 fine
  • 60 days community service
  • 12-48 hours at Intoxicated Driver Resource Center
  • 96 hours-180 days imprisonment
  • an automobile surcharge of $1,000 a year for 3 years
  • $100 surcharge to be deposited in a drunk driving fund
  • $100 Alcohol Education and Rehabilitation Fund

  • 20 years driving privilege suspension
  • $2,000 fine
