Children at least 1 but less than 6 years of age weighing
at least 20 lbs., but less than 40 lbs., must be secured
in a forward-facing child restraint.
4. Children at least of 1 but less than 6 years of
age, weighing at least 40 lbs., but less than 80 lbs.,
must be secured in a belt positioning booster seat with a
lap and shoulder belt.
5. Children at least 1, but less than 6 years of
age, weighing more than 80 lbs. may be secured by a
safety belt.
6. If a child less than 6 years of age can sit
with his back against the vehicle seat back cushion with
his knees bent over the vehicle's seat edge without
slouching, the child may be seated in the regular back
seat and secured by a safety belt.
7. A person found to have violated this provision
may be fined no more than $50. No court costs may be
assessed for a violation of this provision. No points may
be assigned to a driver's license for a violation of the
child restraint laws. The violation does not appear on
the driver's record.
Seatbelt laws:
Secondary Enforcement, however, this law is Primary
Enforcement for drivers and occupants under 17 years of
age.
The South Carolina Annotated Code requires that when
operating a motor vehicle the driver and every occupant
shall wear a seat belt. The driver is responsible for
requiring all occupants 17 years of age and younger, who
do not hold a driver's license or learner's permit, to
wear a safety belt.
1. Secondary Enforcement for anyone 18 years of
age and older.
2. The driver and all front seat passengers of a
passenger motor vehicle shall wear a seat belt on while
the vehicle is in operation. See Child Safety Restraint
law for additional restrictions.
3. This provision does not apply to:
Drivers or occupants whose physical or medical condition
prevents using a seat belt;
4. Rural letter carriers while delivering mail;
5. Persons delivering newspapers or periodical
assigned on home delivery route;
6. Persons riding in vehicles not required to be
equipped with safety belts under federal law; or
7. Persons riding in a passenger vehicle
manufactured before 09/01/73.
10. A $20 fine will be assessed for a violation of
this provision. A violation of this provision will not
appear on a driver's license and may not be reported to
an insurance company. No points may be assigned to a
driver's license. Court fees will not be applied to this
provision.
11. Primary Safety Belt Law: Passage of a primary
safety belt law in South Carolina would allow law
enforcement to stop and ticket a driver for nonuse of a
safety belt without requiring the driver to be cited for
or have committed another offense.
12. A motorcycle helmet law that covers all riders
in South Carolina could save lives and prevent
devastating and debilitating head injuries.
